Prohibited & Restricted Products Policy

Draft product-integrity rules and separate listing, transaction, delivery, and provider eligibility controls.

For merchants reviewing what may not be listed and what requires additional approval.

Draft status and existing terms

This document is a working draft for attorney and business review. It is not yet effective, does not create a binding agreement, and does not activate ordering, payments, delivery, age-verification, or any other commerce capability.

The existing Puffify Merchant Terms of Service and Privacy Policy remain operative. This draft does not amend, replace, or supersede either document. If approved later, final language, precedence, consent, versioning, and effective-date requirements must be confirmed before use.

Nothing in this draft announces or implies approval, sponsorship, endorsement, or operational readiness by Stripe, BlueCheck, Uber, or any other payment, identity, delivery, or technology provider. No new fee, commission, subscription, penalty, or charge is created by this draft.

1. Prohibited products and conduct

Merchants must not offer or promote products that are illegal or that create an unacceptable safety, authenticity, or rights risk.

  • Illegal, stolen, counterfeit, diverted, recalled, adulterated, unsafe, materially damaged, or materially mislabeled products.
  • Products or content that infringe intellectual-property, publicity, privacy, or other rights.
  • False or unsupported medical, health, cessation, regulatory, authorization, approval, efficacy, or safety claims.
  • Products sold without licenses, registrations, warnings, packaging, tax treatment, or records required by law.

2. Restricted categories require independent review

A restricted category may be visible for discovery while transactions and delivery remain disabled. Any commerce involving tobacco, nicotine, e-cigarettes, e-liquid, ENDS, cannabis-related products, controlled substances, weapons, hazardous materials, or another regulated category requires separate legal and provider clearance before enablement.

This draft is not an approved-product list. Puffify catalog inclusion, an age gate, a merchant license, or another merchant's listing does not establish eligibility.

3. Visibility, transaction, and delivery controls

Listing visibility, transaction eligibility, and delivery eligibility are separate layers. A decision at one layer does not satisfy another. Puffify may preserve product-level, merchant-level, destination-level, payment-level, or delivery-level restrictions even when a listing remains visible.

Merchants must not bypass, disable, or misrepresent these controls. Existing eligibility controls remain authoritative; this draft does not loosen them.

4. Payment-provider restrictions

Tobacco and related categories are subject to Stripe restrictions and service-specific eligibility. Puffify has not obtained or represented approval. No processing may be enabled without confirmation of support for the exact business model, products, jurisdiction, and service; prohibited activity remains prohibited.

Stripe's main Restricted Businesses page and its Express FAQ describe tobacco-related eligibility differently. That discrepancy requires written, service-specific clarification from Stripe before any processing is considered. Puffify drafts, age gates, catalog controls, or merchant approval do not establish payment eligibility.

Merchants and Puffify must disclose the true business model and product mix to any provider. They must not misclassify goods, conceal restricted activity, route payments through another account, or split activity to avoid provider review. Only documented, supported activity may be enabled after legal and provider clearance.

5. Product identity and claims

Names, brands, models, editions, strengths, sizes, flavors, images, warnings, and regulatory statements must describe the actual product. Distinct products or editions must not be merged to imply authorization or availability, and generic images must not be represented as flavor-specific.

6. Review and corrective action

Puffify may hide a listing, request evidence or correction, restrict a feature, suspend a merchant, or remove a merchant under the existing lifecycle when safety, legality, authenticity, accuracy, provider eligibility, or rights are uncertain. These actions do not replace reporting, recall, consumer-notice, or regulator-cooperation duties.
