Draft status and existing terms
This document is a working draft for attorney and business review. It is not yet effective, does not create a binding agreement, and does not activate ordering, payments, delivery, age-verification, or any other commerce capability.
The existing Puffify Merchant Terms of Service and Privacy Policy remain operative. This draft does not amend, replace, or supersede either document. If approved later, final language, precedence, consent, versioning, and effective-date requirements must be confirmed before use.
Nothing in this draft announces or implies approval, sponsorship, endorsement, or operational readiness by Stripe, BlueCheck, Uber, or any other payment, identity, delivery, or technology provider. No new fee, commission, subscription, penalty, or charge is created by this draft.
1. Future and conditional scope
This policy describes possible future delivery safeguards. It does not activate Puffify delivery, establish that any category is deliverable, or mean a payment, identity, or delivery provider has approved Puffify's business model.
2. Independent eligibility decisions
Before any future delivery, the merchant, product, order, customer, destination, route, and delivery provider must each independently qualify under current law and approved provider terms. Failure of any one condition means delivery must not proceed.
Listing visibility does not establish transaction eligibility, and transaction eligibility does not establish delivery eligibility. An external delivery link is only a destination supplied by a merchant; it is not Puffify approval of that provider, order, product, or delivery.
3. Timing and availability
Any displayed estimate would be informational and subject to merchant acceptance, inventory confirmation, verification, traffic, safety, and provider availability. No delivery time or completion is guaranteed by this draft.
4. Restricted-product handoff
Restricted goods must be handed only to an eligible adult recipient after all required checks. They must not be left unattended, placed at a door, transferred to a minor, or handed to an unverified proxy.
The handoff must be refused when the intended recipient is absent, the address or circumstances are unsafe, identity or age cannot be verified, ID is absent or unacceptable, or the delivery would otherwise violate approved procedures.
5. Failed delivery or ID check
Refusal prevents handoff; it does not automatically determine the financial result. The order must be reviewed under the approved refund policy, considering whether payment was merely authorized or captured, the reason for failure, applicable law, and any lawfully approved and disclosed term.
Where an order is not fulfilled because of a verified merchant or courier failure, the normal outcome is release of the hold or a refund of amounts paid for goods and services not provided. An incorrect address, unavailable recipient, inaccessible location, refused delivery, or failed age/ID check is reviewed separately and does not automatically mean either a full refund or forfeiture.
This draft creates no automatic forfeiture, attempted-delivery fee, cancellation fee, restocking fee, or return charge.
6. Return and handling controls
Restricted goods may be returned, transported, stored, destroyed, or transferred after a failed handoff only through a lawful procedure approved for the product and provider. Drivers and customers must not improvise returns or leave goods at an alternate location.
7. PACT, state, local, and carrier review
Before launch, counsel must determine which products and delivery models fall within the federal PACT Act or other federal, state, tribal, local, carrier, tax, reporting, registration, labeling, and recordkeeping requirements. A technically available route or external link cannot substitute for that analysis.
