Age Verification Policy

Draft 21+ access, verification, handoff, privacy, and merchant responsibility standards.

Draft status and existing terms

This document is a working draft for attorney and business review. It is not yet effective, does not create a binding agreement, and does not activate ordering, payments, delivery, age-verification, or any other commerce capability.

The existing Puffify Merchant Terms of Service and Privacy Policy remain operative. This draft does not amend, replace, or supersede either document. If approved later, final language, precedence, consent, versioning, and effective-date requirements must be confirmed before use.

Nothing in this draft announces or implies approval, sponsorship, endorsement, or operational readiness by Stripe, BlueCheck, Uber, or any other payment, identity, delivery, or technology provider. No new fee, commission, subscription, penalty, or charge is created by this draft.

1. 21+ tobacco and nicotine access

Puffify is intended for adults age 21 or older where tobacco, nicotine, electronic nicotine delivery systems, or other age-restricted products are displayed. Federal Tobacco 21 rules prohibit retailers from selling tobacco products to anyone under 21; state and local requirements may be stricter or broader.

A date-of-birth entry, checkbox, age gate, or verbal statement is a self-declaration. It is not verified age and must not be presented as verification.

2. Future online verification

Any future restricted-product ordering flow would require approved age and, where necessary, identity verification before a transaction proceeds. The provider, verification method, fallback process, decision handling, notices, accessibility, and privacy treatment remain subject to legal and provider review.

This draft does not state that BlueCheck or any other named service is live, approved, or selected. Passing an online check would not remove the need for lawful merchant and handoff checks.

3. Government photo-ID handoff check

For a future pickup or delivery of restricted goods, the person receiving the goods must present an acceptable, current government-issued photo ID when required. The merchant or approved delivery participant must compare the person, age, and order information under approved procedures.

  • Refuse handoff when ID is absent, expired, materially altered, unreadable, unverifiable, or does not match the intended eligible recipient.
  • Refuse handoff when the recipient appears underage or when another person is attempting to receive restricted goods by proxy.
  • Do not leave restricted goods unattended or with a minor.

4. No proxies or circumvention

Customers and merchants must not use another person's identity, account, payment method, or address to evade an age check. Merchants may not override or bypass required verification because a customer is familiar, previously verified, or claims urgency.

5. Merchant duties remain

Technology assists but does not replace retailer obligations. Each merchant remains responsible for training staff, applying applicable age-verification law, maintaining required records, refusing unlawful sales, and following product-specific rules at every location and handoff.

6. Data minimization and secure handling

Only information reasonably needed for the approved verification purpose should be collected. Raw ID images and full document numbers must not appear in ordinary application logs, analytics, support notes, or email.

Any transmission or storage must use an approved secure channel with access controls. Final decisions about data fields, provider access, retention, deletion, appeals, privacy notices, and legally required records remain unresolved pending attorney and privacy review.

7. Verification failure and refusal

When required verification cannot be completed, restricted goods must not be handed over. Any payment or order consequence must be reviewed under the approved Refund & Cancellation Policy; failed verification alone does not create automatic forfeiture under this draft.
